Judge Ruehlman Has Saved Our Community!
Late December 8th, 2011 Judge Ruehlman signed a lengthy written
decision reversing the Anderson Township Board of Zoning Appeals'
approval of the Martin Marietta mining operation. In his decision, Judge
Ruehlman said the BZA had exceeded its authority and that its approval
of the mine was not supported by the evidence in the record. He even
noted that some of Martin Marietta's witnesses lacked credibility.
It was obvious to those of us who attended the hearing before Judge
Ruehlman that he had taken the time to read the full 3000 page
transcript of hearings before the BZA and understood the impacts that
the proposed mining operation would have on our community. His detailed
written decision showed a thorough understanding of the issues. We shall
be forever grateful to Judge Ruehlman for saving our community from the
health and safety impacts of the mining operation.
Please understand that this controversy is not over. Martin
Marietta has the right to appeal Judge Ruehlman's decision to the First
District Court of Appeals and may have other legal options as well. But,
we are now in a much better position to prevail than if we were the
ones who had to appeal.
For now, let's enjoy our victory as we
enter the holiday season. On
